Privacy Policy

The short version. We ask for your household details so we can show you real Affordable Care Act plans and prices, and for your name, email and phone so a licensed agent can go through them with you. We use that information to quote you, to contact you about coverage, and for nothing else. We do not sell your information, and we never share your health details, income or contact details with advertising platforms. The full detail is below.

Who we are

This site is operated by BAM Insurance Agency, a licensed insurance agency. Coverage is offered through Brandon Amaya Marquez, National Producer Number 19360679. We are an independent insurance agency.

We are not affiliated with, endorsed by, or acting on behalf of HealthCare.gov, the Centers for Medicare & Medicaid Services, or any government agency. This site is a solicitation for insurance.

Information we collect

Information you give us. As you move through the questions on this site, we collect:

  • Your ZIP code, which we use to identify your county. Prices are set county by county.
  • Household details: how many people are in your household, your expected annual income for the year, the date of birth of each person who needs coverage, whether anyone uses tobacco, and whether anyone is pregnant. Insurers price on age and tobacco use, and your income determines the premium tax credit you qualify for. We ask for dates of birth rather than ages because a plan is priced on your age on the day coverage starts, which may not be your age today.
  • When you want coverage to start, and whether you have had a recent life change (losing coverage, moving, marrying, having a child, or a significant income change), which is what allows enrollment outside the annual Open Enrollment window.
  • Your contact details: first and last name, email address and phone number, along with your agreement to be contacted.
  • Optionally, your doctors and prescriptions. After you give us your contact details we ask, on a step you can skip entirely, for the doctors or facilities you want to keep and the medications you take. This is so your agent can check they are covered before you enroll. Leaving it blank does not change your prices or stop you enrolling.

Information collected automatically. When you submit the contact form we record your IP address, your browser user-agent string, the page URL you were on, and the date and time, together with the exact wording of the consent you agreed to. This is a legal record of consent for calls and texts, and it is the reason we can show what you agreed to and when. We also use one first-party cookie described under Cookies and tracking.

Information from the ad you clicked. If you arrived from an advertisement, the link carries campaign tags (such as the campaign, source and medium). We store these so we know which advertising is working.

What we never ask for on this site. We do not collect your Social Security number, immigration or citizenship status, or bank or payment details. If you choose to apply, you complete the application on HealthSherpa's own secure pages, and that information goes to them. It never passes through this site.

Sensitive information

Some of what we collect is treated as sensitive under state privacy laws: pregnancy status, tobacco use, the medications you list, the doctors you name, and your household income. Several states, including Washington, Nevada and Connecticut, regulate consumer health data specifically.

We handle it accordingly. This information is used only to quote your coverage and to prepare your licensed agent for your conversation. It is never used for advertising, never shared with any advertising platform, and never sold. If you would rather not provide the doctor and prescription details at all, skip that step. The funnel is built to work without it.

How we use your information

  • To find the plans and prices available in your county.
  • To estimate the premium tax credit your household qualifies for, which depends on your income and household size.
  • To let a licensed agent contact you about your options, answer questions, and help you enroll, by phone, text or email, as you agreed.
  • To pass your details to the enrollment platform when you choose a plan, so you do not have to type them again.
  • To let your agent check that your doctors and medications are covered, and to stay useful to you as your coverage needs change over the years.
  • To keep a record of your consent, to meet insurance and telemarketing recordkeeping obligations, and to detect misuse of the site.
  • To measure which advertising brought people to the site. See Advertising and analytics.

Who we share it with

We share your information only with the companies we need to run this service, and only for the purposes described here. They are contractually limited to those purposes.

Meta (Facebook)Advertising measurement only. Receives the fact that a visit reached a given step, and the identifier of a plan if one is chosen. It does not receive your name, email, phone, income, date of birth, pregnancy or tobacco answers, doctors or medications.
Vercel and SupabaseOur hosting and database providers. They store and serve the data on our behalf and do not use it for their own purposes.

We may also disclose information if the law requires it, to respond to a lawful request from a regulator or court, to enforce our terms, or to protect the rights and safety of any person. If our business is sold or merged, information may transfer as part of that transaction.

We do not sell your personal information for money, and we do not pass your details to other agents, lead buyers or marketing companies.

Cookies and tracking

We use one strictly necessary first-party cookie to carry your answers from one step to the next. It is encrypted, it expires after one hour, and the site cannot function without it.

We also run the Meta pixel on this site to measure our advertising. It records that a visit reached certain steps (viewing the household questions, becoming a lead, and starting an application) and may read or write cookies set by Meta in your browser. As explained above, we deliberately do not send Meta your name, email address, phone number or any health or income detail. If your browser sends the Global Privacy Control signal, this pixel does not load at all. See Advertising and analytics.

Advertising and analytics

Under some state privacy laws, using an advertising pixel counts as “sharing” for targeted advertising even though no money changes hands and no identifying details are sent. We want to be straightforward about that rather than hide behind the distinction.

We honor Global Privacy Control. If your browser or a browser extension sends the GPC signal, we treat it as a request to opt out of sharing for targeted advertising, and the advertising pixel is switched off for your visit entirely. It is never loaded, sets no cookie, and reports nothing. You do not need to contact us or fill anything in, and the site works exactly as it otherwise would. GPC is built into browsers including Firefox, Brave and DuckDuckGo, and is available as an extension for others.

You can also limit it in any of these ways:

  • Adjust your ad preferences in your Facebook or Instagram account settings.
  • Use your browser's tracking-protection settings, or an ad or tracker blocker. This site works normally with them switched on.
  • Contact us using the details below and ask us to stop sharing your information for targeted advertising, and we will.

Opting out of advertising does not stop us quoting you or your agent contacting you about coverage. Those are what you came here for, and they are handled separately under Calls, texts and emails.

Calls, texts and emails

When you check the consent box and submit your details, you give us your prior express written consent for BAM Insurance Agency and its licensed agents to contact you at the number and email you provided (including by automated dialing system, prerecorded or artificial voice, and text message) about health insurance and your eligibility for coverage.

Consent is not a condition of purchase. Message and data rates may apply. You can withdraw consent at any time: reply STOP to any text, ask the agent on any call to remove you, or contact us using the details below. We keep the record of your original consent after you opt out, because that record is what demonstrates the earlier contact was lawful.

How long we keep your information

We keep lead and consent records for as long as needed to serve you and to meet insurance and telemarketing recordkeeping requirements, generally at least five years from your last interaction with us, which reflects the limitation periods that apply to telemarketing consent. Your session cookie is discarded after one hour. You can ask us to delete your information sooner, as described below.

How we protect your information

Your answers travel over an encrypted connection, the session cookie holding them is itself encrypted, and our database is access-controlled and hosted in the United States. Your Social Security number and immigration status are never collected here at all. The enrollment platform handles those on its own approved systems, which is a deliberate design choice rather than a limitation.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your privacy rights

Wherever you live, you can ask us to:

  • Tell you what personal information we hold about you.
  • Give you a copy of it.
  • Correct it if it is wrong.
  • Delete it.
  • Stop contacting you, or stop sharing your information for advertising.

Residents of states with comprehensive privacy laws, including California, Colorado, Connecticut, Virginia, Texas, Oregon, Montana and others, have these rights by statute, along with the right to limit the use of sensitive personal information and the right not to be treated differently for exercising them. We apply these rights to everyone rather than checking your state first.

To make a request, contact us using the details below. We will verify your identity by confirming details you already gave us, and respond within the time the law allows, 45 days in most states. An authorized agent may make a request on your behalf with your written permission.

Children

This site is meant for adults aged 18 and over. We do not knowingly collect information directly from children. A parent may of course include a child as a member of the household needing coverage. In that case we collect only the child's age, and nothing that identifies them.

Changes to this policy

If we change what we collect or who we share it with, we will update this page and change the date at the top. Material changes will be reflected here before they take effect.
